This policy (together with our terms of use and any other documents referred to on it) sets out the basis on which any personal data we collect from you and the company/organisation you represent (“your organisation”), or that you or your organisation provide to us, will be processed by us. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it. INFORMATION WE MAY COLLECT FROM YOU

We may collect and process the following data about you:

Information you or your organisation gives us. You may give us information about you by filling in forms on our sites (our sites) or by corresponding with us by phone, e-mail, paper or otherwise. This includes information you or your organisation provide when you register to use our sites, subscribe to our service, join one of our user groups or participate in discussion boards or other social media functions on our sites, enter a competition, promotion or survey, and when you report a problem with our sites/products/services. The information you or your organisation give us may include your name, role, company name, company activity, address, e-mail address and phone number, financial information, personal description and photograph.

INFORMATION WE COLLECT ABOUT YOU

With regard to each of your visits to our sites we may automatically collect the following information:

  • technical information, including the Internet protocol (IP) address used to connect your computer to the Internet, your login information, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform;
  • information about your visit, including the full Uniform Resource Locators (URL) clickstream to, through and from our sites (including date and time); products you viewed or searched for; page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page and any phone number used to call our customer service number.
  • Information we receive from other sources. We may receive information about you if you use any of the other websites we (or other companies within our group) operate or the other services we provide. We are also working closely with third parties (including, for example, business partners, sub-contractors in technical, payment and delivery services, advertising networks, analytics providers, search information providers, credit reference agencies) and may receive information about you from them.

To carry out our obligations (and exercise our rights) arising from any contracts/arrangement entered into between you/your organisation and us and to provide you/your organisation with the information, products and services that you/your organisation request from us.

 

Where our contract/arrangement is with you (personally), we rely on Article 6(1)(b) of the GDPR (processing necessary for the performance of a contract with the data subject) as the lawful basis for use.

 

Where our contract/arrangement is with your organisation, we rely on Article 6(1)(f) of the GDPR (processing necessary for legitimate interests pursued by the controller or a third party) as the lawful basis for use on the basis that our rights and obligations under the contract/arrangement (and more generally, our business) are legitimate and the data processing activities that we and (where appropriate) our third parties perform are proportionate and secure and have due regard to your rights and freedoms.

 
The personal data will be retained for no longer than is reasonably necessary and, in any event, no longer than the applicable limitation period of the most recent, applicable contract/arrangement.  

To provide you with information about other goods and services we offer that are similar to those that you/your organisation have already purchased, searched for, or enquired about.

 
We will only process your personal data for this purpose where you have provided consent (and in which event, we rely on Article 6(1)(a) of the GDPR (processing pursuant to consent from the data subject) as the lawful basis for use). 

Your personal data will be retained for this purpose until:

  1. We no longer reasonably require it for these purposes; or
(if earlier) you withdraw your consent**. 
To provide you/your organisation, or permit other organisations within our group of companies (or their appointed representatives) to provide you with information about goods or services we feel may interest you/your organisation.  We will only process your personal data for this purpose where you have provided consent (and in which event, we rely on Article 6(1)(a) of the GDPR (processing pursuant to consent from the data subject) as the lawful basis for use). 

Your personal data will be retained for this purpose until:

  1. We no longer reasonably require it for these purposes; or
  2. (if earlier) you withdraw your consent**.
 

To assess personal data submitted directly by you (or by an agency on your behalf) for the purpose of a job application or a speculative employment inquiry.

 

We rely on Article 6(1)(a) of the GDPR (processing pursuant to consent from the data subject) as the lawful basis for use.

 

 

 

 

 

 

Where you are subsequently employed by us, certain personal data may be continued to be retained and processed under an alternate legal basis (“processing necessary for the performance of a contract with the data subject” pursuant to Article 6(1)(b) of the GDPR).

 

Where you subsequently contract to provide services on a non-employed basis (whether directly or via use of a service company), certain personal data may be retained and processed under an alternate legal basis (“processing necessary for the performance of a contract with the data subject” pursuant to Article 6(1)(b) of the GDPR) t.

 

Unless you consent to us holding personal data for a longer period, your personal data will be retained for no longer than is reasonably necessary and in any event within 6 months of the closure of the relevant recruitment campaign.

 

In these circumstances, any such use and retention of your personal data will be subject to our internal employee data protection procedures.

 

 

 

 

In these circumstances, certain personal data may be retained for a longer period but no longer than is necessary. In most instances, this may period may be determined by the applicable limitation period of the most recent, applicable contract between us and you but in some circumstances some basic personal data (such as name and business contact details) may exist on certain records/correspondence (for example relating to ongoing customer/supplier contracts) for a longer period of time.  

 

* Please note that, beyond the stated retention period data will be deleted or otherwise put beyond use in accordance with the current guidelines issued by the Information Commissioner’s Office.

** In terms of how to withdraw consent, please see “Unsubscribing” in the “YOUR RIGHTS” section (below).

 

  • Information we receive from other sources. We may combine this information with information you/your organisation give to us and information we collect about you. We may use this information and the combined information for the purposes, legal basis and retention periods set out above (depending on the types of information we receive).

 

DISCLOSURE OF YOUR INFORMATION

We may share your personal and company information with any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries, as defined in section 1159 of the UK Companies Act 2006.

We may share your information with selected third parties including:

  • Business partners, suppliers, distributors, agents and sub-contractors for the performance of any contract we enter into with them or you/your organisation.
  • Other companies within the same corporate group as SERVELEC CONTROLS LIMITED that either assist us specifically with the administration of the contract we have with you/your organisation OR that otherwise assist us more generally with our normal business operations.
  • Analytics and search engine providers that assist us in the improvement and optimisation of our sites.

 

We may also disclose your personal information to third parties in the following circumstances:

  • In the event that we sell any business or assets, in which case we may disclose your personal data to the prospective buyer of such business or assets.
  • If SERVELEC CONTROLS LIMITED or substantially all of its assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets.
  • If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our terms of use and other agreements; or to protect the rights, property, or safety of SERVELEC CONTROLS LIMITED, our customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.

 

 

WHERE WE STORE YOUR PERSONAL DATA

By submitting your personal data, you agree to this transfer, storing or processing set out above. We will take all steps reasonably necessary to ensure that your data is treated securely, and in accordance with this privacy policy.

All information you provide to us via our websites is stored on our secure servers in the UK. We have appropriate security measures in place to prevent personal information from being accidentally lost, or used or accessed in an unauthorised way. We limit access to your personal information to those who have a genuine business need to know it. Those processing your information will do so only in an authorised manner and are subject to a duty of confidentiality.

We also have procedures in place to deal with any suspected data security breach. We will notify you and any applicable regulator of a suspected data security breach where we are legally required to do so.

Where we have given you (or where you have chosen) a password which enables you to access certain parts of our sites, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our sites; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.
